Terms and Conditions
1. Introduction
Welcome to Pension Care ("we," "our," "us"). By accessing or using our website, pensioncare.net ("Site"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using our services.
2. Services
Pension Care specialises in reviewing NHS pension calculations to identify potential errors that may have led to underpayments. Our services include:
Reviewing your NHS pension benefits and service records.
Identifying discrepancies or errors in pension calculations.
Assisting in rectifying identified issues to ensure accurate pension payments.
3. Eligibility
To use our services, you must:
Be a former or current member of the NHS Pension Scheme.
Provide accurate and complete information necessary for the pension review process.
Agree to our 'no win, no fee' basis, where fees are applicable only if we identify errors that result in increased pension benefits or arrears.
4. 'No Win, No Fee' Basis
Our fee structure operates as follows:
If no errors are found in your pension calculations, no fees are charged.
If errors are identified that lead to increased pension benefits or arrears, we charge 25% of any arrears paid to you. This includes both pension arrears and any lump-sum payments resulting from the correction.
Calculation Based on Gross Amounts
Our fee is calculated based on the gross arrears amount before any deductions such as tax or National Insurance contributions. The net amount you receive after deductions may be lower than the gross amount, but our fee remains calculated on the full gross figure.
Example:
Suppose we identify an underpayment in your NHS pension that results in arrears of £10,000 (gross).
Our fee would be 25% of £10,000, which is £2,500.
However, depending on your tax rate and personal circumstances, you may receive a lower net payment after deductions. For example, if tax and National Insurance contributions total 20%, your net arrears payment might be £8,000 instead of £10,000.
Even in this case, our fee remains £2,500, based on the original gross arrears amount.
It is important to consider how tax and other deductions may impact the final amount you receive. If you have any concerns about how this might affect you, we recommend seeking independent financial or tax advice.
5. User Responsibilities
By engaging our services, you agree to:
Provide accurate, current, and complete information as requested.
Promptly notify us of any changes to your information.
Use our services solely for lawful purposes and in accordance with these Terms.
6. Limitation of Liability
While we strive to provide accurate and efficient services, Pension Care is not liable for:
Any indirect, incidental, or consequential damages arising from the use of our services.
Errors or omissions in information provided by you or third parties.
Delays or failures in service delivery due to circumstances beyond our control.
7. Termination
We reserve the right to terminate or suspend your access to our services, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
